Please carefully read these Terms and Conditions for Angeline Cruise, operated by Tedulous Travel & Tours Sdn. Bhd. (“Operator,” “we,” “us,” “our”), which apply to all guests (“Guests”) and agents (“Agents”). The Operator shall be entitled to vary, amend, and/or otherwise change these terms and conditions at any time without prior notice. All images displayed on our website are for illustration purposes only. The actual appearance and conditions of the services, activities, and destinations may vary.

Reservations, Charges, and Payments

  1. Reservations are subject to availability and confirmation by the Operator.
  2. A 50% deposit of the charter fee is required upon confirmation, with the remaining 50% due at least three (3) days before the travel date.  
  3. A confirmed booking is valid only for the specified travel date and guest names.
  4. Guests and/or Agents must provide accurate names and passport/NRIC numbers. The Operator is not liable for any incorrect or incomplete information.
  5. By proceeding with the reservation, Guests agree that their trip will be subject to the Operator’s standard policies, terms, and conditions.
  6. Unless otherwise specified, entrance fees, taxes, surcharges, add-ons, and incidental charges are excluded.
  7. The Operator may, at its absolute discretion, cancel the reservation if the provided reservation information is falsified or incomplete.

Modification, Cancellation, and No Show

  1. Modifications, such as changing the travel date or guest names, are allowed subject to availability and may incur additional fees.  
  2. Modifications / cancellations must be made at least seven (7) days before the travel date. Please contact us for any modification / cancellation requests.
  3. No refunds will be given for no-shows or cancellations made less than seven (7) days before departure.
  4. Unused activities included in the package will not be refunded.
  5. The Operator is not liable for any failure or delay in the performance of its obligations, or for any direct, indirect, punitive, incidental, or consequential damages caused by events beyond its reasonable control. These events include, but are not limited to, acts of God, natural disasters, war, terrorism, strikes, labour disputes, civil disturbances, severe weather, machinery failure, pre-existing illness, third-party negligence, or governmental actions. In such cases, the Operator may offer alternatives or reschedule the trip, but no refunds will be provided.

Operations

  1. Guests are responsible for arriving on time at the pick-up or meeting point.
  2. The Operator reserves the right to determine the type of vessel and land transport used. Guests must observe the maximum passenger limits.
  3. Weather, sea conditions, and water visibility are beyond the Operator’s control.
  4. The risk of damage or loss of personal belongings during the cruise or transport lies with the Guests. Guests are responsible for any damage to the Operator’s property or the property of third parties caused by their actions. The Operator reserves the right to charge Guests for the cost of repairs or replacements.
  5. Guests agree to release, indemnify, and hold the Operator harmless from any claims or causes of action for injury, death, or other damages, whether due to the Operator’s negligence or otherwise, arising from their participation in the cruise or related activities.
  6. Guests are expected to respect the marine environment. The Operator enforces a strict “no touching” policy regarding marine life and coral reefs. Littering, waste disposal in the sea, and other environmentally harmful behaviors are prohibited.
  7. The Operator encourages Guests to participate in sustainable practices during the trip, such as minimizing plastic use and conserving water and energy.
Healthy, Safety and Security
  1. Guests must inform the Operator of any pre-existing medical conditions or special requirements at the time of reservation. The Operator may refuse to allow participation in certain activities if deemed unsafe due to health concerns.
  2. By proceeding with the trip, Guests confirm they are physically fit to participate and have no health concerns that could be affected by the trip. They acknowledge that the vessel has limited medical capabilities, and the Operator’s crew will seek professional medical assistance if needed, with all associated costs borne by the Guests.
  3. Guests acknowledge the risks associated with water activities, including but not limited to equipment failure, adverse sea and weather conditions, drowning, and the actions of other Guests.
  4. Guests must attend and adhere to all safety briefings and instructions provided by the Operator’s crew.  
  5. Guests must not be under the influence of illegal drugs, excessively intoxicated, or consume any medication that could impair their abilities during the trip. They must also refrain from bringing contraband or engaging in any illegal activities.  
  6. Guests are expected to behave respectfully towards other Guests, the Operator’s crew members, and local communities. We do not tolerate acts of violence, vandalism, or any other forms of commotion or disturbance.  
  7. Non-compliance with safety instructions, as well as any disruptive, abusive, or illegal behavior, may result in exclusion from certain activities or immediate removal from the entire trip without a refund. The Operator also reserves the right to reprimand such Guests, report them to the authorities if necessary, and seek compensation for damages if any.
Agents and Governing Law
  1. Agents are not allowed to publish prices other than the recommended selling prices provided by the Operator. Failure to comply may result in the Operator not honouring the sale.
  2. Agents are responsible for ensuring that Guests are informed of and understand these Terms and Conditions before the trip.
  3. The Operator shall not be held liable for any misrepresentation, mis-selling, or misinformation provided by Agents.
  4. These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
  5. Our failure to enforce any right or provision of these Terms and Conditions does not constitute a waiver of those rights.
  6. If any provision of these Terms and Conditions is held invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms and Conditions constitute the entire agreement between us and supersede any prior agreements regarding Angeline Cruise.
